10 Services and Third-Party Providers

EverLume markets and coordinates residential solar and battery offerings that are designed, installed, and serviced by licensed third-party partners. Any quote, proposal, or estimate provided before a signed agreement is preliminary and subject to a site assessment, credit review where applicable, and the terms of the definitive agreement you sign. The identity of the installing and financing party, and the complete terms of the offering, are disclosed in that agreement.

11 Limitation of Liability and Dispute Resolution

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our Services. Our total liability for any claims arising under these Terms shall not exceed the amount paid by you, if any, for the Services in the twelve (12) months preceding the claim.

Any dispute arising out of or related to these Terms or the Services shall be governed by the laws of the State of Illinois without regard to its conflict of law principles. You agree to attempt to resolve disputes informally before taking any legal action.

12 Carrier Disclaimer

By opting to receive SMS communications from EverLume, you acknowledge and agree that mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and may be affected by factors outside of EverLume's control, including carrier network availability or technical limitations.

Standard message and data rates may apply depending on your mobile carrier and service plan. Users are responsible for any charges incurred for receiving SMS messages.

13 Disclosures

All offers are subject to availability, customer qualification, program eligibility and agreement terms. The provider who installs and services your system is named in your proposal and agreement. Photography on our website is illustrative and does not depict a specific customer, installation or result.
